Welcome to The Art of Sound Healing Inc. (“Company,” “we,” “us,” or “our”). These Terms of Service (“TOS”) govern your use of our website located at www.theartofsoundhealing.com (the “Site”) and any related services, including but not limited to in-person sessions, events, or SMS/text messaging (collectively, the “Services”). By accessing or using our Site or Services, you agree to be bound by these TOS and our Privacy Policy (and, if applicable, our Cookie Policy). If you do not agree with these TOS, please do not use our Site or Services.

1. Description of Services

We provide various wellness-related services, including sound bed sessions, breathwork sessions/classes, vocal analysis, and both private and group sound bath events. We may also offer products (e.g., pendants or other wellness items) for sale. These Services are provided in-person at our location(s) or events, and we use this Site to share information, schedule appointments, process payments, and communicate with clients.

1.1. No Substitute for Medical Advice

We are not medical professionals, and the Services we provide are not intended to diagnose, treat, cure, or prevent any disease or ailment, nor replace professional medical advice or treatment. If you have concerns about your health, please consult a licensed medical professional.

1.2. No Guarantee of Outcomes

Results and experiences may vary from person to person; we do not guarantee any specific physical, emotional, or spiritual outcome from our Services.

2. Eligibility & Minors

  • Our Site and Services are intended for individuals 18 years of age or older.
  • If you are a minor (under 18), you may use our Services only under the supervision and with the consent of a parent or legal guardian.
  • If a parent or legal guardian brings a minor to an in-person session, they must supervise the minor at all times and are fully responsible for the minor’s compliance with these TOS.

3. Electronic Communications & SMS/Text Messaging

By accessing our Site, sending us emails, or providing your mobile phone number for scheduling or Service updates, you consent to receive electronic communications (including emails or SMS/text messages) from us.

3.1. Transactional SMS (A2P Compliance)

We may send occasional text messages for scheduling confirmations, reminders, logistical updates, or other transactional (non-marketing) purposes.

  • Opt-In: By providing your mobile phone number, you authorize us to send you such messages.
  • Message & Data Rates: Your carrier’s standard messaging and data rates may apply.
  • Opt-Out: You can opt out of receiving text messages at any time by replying STOP to any text message you receive from us or by contacting us at info@artofsoundhealing.com. After opting out, you may receive a one-time confirmation, and then we will remove you from our texting list within a reasonable timeframe.
  • Help: If you need assistance, reply HELP to the text message or email us at info@artofsoundhealing.com.

4. Appointments, Payment, & Cancellation Policy

4.1. Appointment Scheduling & Payment

You may schedule individual services (such as sound bed sessions, vocal analysis, or breathwork appointments) through our Site, by phone, or by email. We use a third-party payment processor (e.g., credit card gateway) to securely handle payments. By submitting your payment information, you authorize us (and our payment processor) to charge you for all requested Services.

4.2. 48-Hour Cancellation / Refund Policy

  • Cancellation Window: We require at least 48 hours’ notice for any cancellations or rescheduling. If you cancel within this 48-hour window (or fail to attend your appointment), you will not receive a refund.
  • Extenuating Circumstances: If an emergency or extenuating circumstance arises, please contact us at info@artofsoundhealing.com. While we cannot guarantee a refund or reschedule outside of policy, we will evaluate on a case-by-case basis.

5. Future E-Commerce & Product Purchases

We may, in the future, sell products (like pendants or other wellness items) via our Site. Additional terms regarding shipping, returns, and related policies may apply once online sales are activated. For now, all product purchases and returns occur in-person at events or at our office.

6. Privacy Policy

Your use of our Site and Services is also governed by our Privacy Policy, which details how we collect, use, and protect your personal information. We do not knowingly sell or rent your personal information to third parties. We do, however, utilize third-party analytics tools (e.g., Google Analytics) to improve Site functionality and user experience. 7. Intellectual Property & Blog Content

All content on our Site—including but not limited to text, images, videos, logos, blog posts, and other materials—is the property of The Art of Sound Healing Inc. or its content suppliers, and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit our content without our express written permission.

7.1. No User-Generated Comments/Posts

Currently, we do not allow user comments or forum posts on our Site. Should we enable these features in the future, any user-generated content must comply with these TOS, and we reserve the right to remove any content we deem inappropriate or unlawful.

8. Third-Party Links & External References

We may reference or link to third-party websites, tools, or articles within our Site or blog posts for informational purposes. We have no control over the content, accuracy, or availability of these external resources, and their inclusion does not imply endorsement. Your use of any third-party resources is at your own risk and subject to those parties’ terms and conditions.

9. Cookies & Analytics

We use cookies, tracking pixels, and third-party analytics (e.g., Google Analytics) to collect information about how you use the Site, which helps us improve user experience. 10. Disclaimer of Warranties & Limitation of Liability

  1. Disclaimer: Our Site and Services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.
  2. No Guarantee: We do not guarantee that the Site or Services will be error-free, uninterrupted, secure, or produce any specific results. We further do not guarantee any particular outcome from sound healing, breathwork, or related services.
  3. Limitations: To the maximum extent permitted by law, The Art of Sound Healing Inc. shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site or Services.

11. Arbitration & Class Action Waiver

11.1. Arbitration Agreement

If a dispute arises out of or relates to these TOS or your use of the Site or Services, and cannot be settled through negotiation, the dispute shall be resolved exclusively by final and binding arbitration under the Federal Arbitration Act. The arbitration shall be conducted by a single arbitrator and administered by the American Arbitration Association (AAA) or a similar arbitration service in a location agreed upon by both parties (or, if no agreement, in Orange County, California). The arbitrator’s award shall be final, and judgment may be entered in any court having jurisdiction.

11.2. Class Action Waiver

All claims must be brought in the parties’ individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. By using our Site or Services, you agree to waive the right to participate in a class action lawsuit.

11.3. Attorneys’ Fees

In any arbitration arising out of or relating to these TOS, the prevailing party shall be entitled to recover its reasonable attorneys’ fees and all related costs from the other party.

12. Governing Law & Jurisdiction

Except to the extent governed by the Federal Arbitration Act, these TOS and any dispute arising hereunder shall be governed by the laws of the State of California, without regard to its conflict of law principles. Subject to the arbitration provision above, any legal action shall be brought exclusively in the state or federal courts located in Orange County, California, and both parties consent to jurisdiction there.

13. Modifications & Updates

We reserve the right, at our sole discretion, to modify or replace any part of these TOS at any time. It is your responsibility to check this page periodically for changes. Your continued use of the Site or Services after any such changes constitutes acceptance of those changes.

14. Severability & Waiver

  • Severability: If any provision of these TOS is deemed unlawful, void, or unenforceable, that provision will be deemed severable and will not affect the validity and enforceability of the remaining provisions.
  • Waiver: Our failure to enforce any right or provision of these TOS shall not operate as a waiver of such right or provision.

15. Entire Agreement

These TOS, together with our Privacy Policy (and any separate Cookie Policy) and any additional terms you agree to when using specific elements of our Services, constitute the entire agreement between you and The Art of Sound Healing Inc. regarding your use of the Site and Services.
